TERMS AND CONDITIONS


'Dancing With The Stars' Voting is the process of registering a vote for your favourite Celebrity either via SMS or by calling a 1902 number as advertised on the program during 'Dancing With The Stars' on The Seven Network.

Your use of, and/or access to the SMS or 1902 voting services constitutes your agreement to the Terms of Use. The Seven Network and Freehand Productions Pty Ltd reserve the right to amend the Terms of Use at any time. Since you are bound by these Terms of Use, you should ensure that you have read and fully understood them. The Terms of Use are available on the Seven Network website (www.yahoo7.com.au).

By voting, you will be automatically entered into the competition for a chance to win one of two Nissan Tiida's valued at $48,370.

Entry into the competition is in accordance with the Nissan 'Dancing With The Stars VIII Viewer Voting' Promotion terms and conditions. The terms and conditions and are available on the Yahoo!7 website (www.yahoo7.com.au) and will govern the rules of the competition. The Promoter of the is Seven Network (Operations) Limited (ABN 685 052 845 262) and the competition is authorised under VIC permit number: 08/3608, SA permit number: T 08/3308, NSW permit number: LTPS/08/07993, ACT permit number: TP 08/03288.

1. 'Dancing With The Stars' SMS Voting is open to users who are connected to the Telstra, Vodafone, Optus, Virgin, Orange, 3 and participating service provider customers with SMS compatible mobile digital phones.

2. 'Dancing With The Stars' 1902 voting is open to users who have access to 190 telephone-calling services.

4. When registering your vote using the 'Dancing With The Stars' SMS voting service, you will receive an SMS message in return to confirm your vote has been received.

5. To cast a Telephone vote for your favourite Celebrity, using the 'Dancing With The Stars' 1902 Voting Service, you must call the 1902 number that corresponds to your favourite Celebrity, as advertised during the programme. Each Celebrity's associated 1902 number is detailed below:

6. Upon registering your vote using the 'Dancing With The Stars' 1902 voting service, you will hear a recorded message on the telephone line, confirming receipt of your vote.

7. You must ensure that all care is taken when dialling or sending messages to both the SMS and 1902 voting services. It is your responsibility to ensure that you dial the correct numbers or SMS the correct name. The Seven Network, Freehand Productions Pty Ltd and the voting service provider will not be liable for costs incurred, responses received or any other consequences of user error.

8. 'Dancing With The Stars' Voting service will be available from Sunday 31 August, 2008 and will continue until the date notified to viewers as part of the broadcast of the Programme. The service will first be available for all states from approximately 9:30pm AEST on Sunday 31 August 2008 until 7:30pm AEST on Sunday 7 September 2008. Then from each week thereafter (from Sunday 7 September 2008 onwards), the service will be available from the time notified to viewers as part of the broadcast of the Programme AEDT/AEST each week until 7:30pm AEDT/AEST the following Sunday night, unless otherwise notified to viewers as part of the broadcast each Sunday, based on Eastern State's Time-zones.

9. The times of the opening and closing of the 'Dancing With The Stars' voting using both the 'Dancing With The Stars' 190 and SMS Voting Services are subject to change and may not be the same each week, however this will be clearly communicated to viewers as part of the broadcast of the Programme.

10. Votes registered using the 'Dancing With The Stars' 1902 Voting service, will be charged at 55 cents (including GST). Calls made from mobile phones may attract a higher rate.

11. Votes registered using the 'Dancing With The Stars' SMS voting service, will be charged up to 55 cents (including GST). This includes Telstra, Vodafone, Optus, Virgin, Orange, 3 and participating service provider customers.

12. Any SMS votes submitted and received by the m.Net Corporation database after the specified voting period has closed will not be included in the vote tally for that period but will be charged 55 cents (including GST).

13. Any 1902 votes registered and received by the m.Net Corporation database after the specified voting period has closed will not be included in the vote tally for that period but will be charged at 55 cents (including GST).

14. SMS entries via the internet or computer generation are invalid and will not be accepted.

15. The Seven Network will donate a percentage (%) of their share of revenue received from votes registered for each Celebrity, to the charity of each Celebrity's choice.

SCORING
16. During the Programme, after each Celebrity's performance, the panel of judges will be asked for their score. Once all couples have danced, the points they receive are turned into a ranking; the Celebrity/s with the lowest score from the judges receives 1 point and the Celebrity/s with the highest score receives the number of points equal to the number of Celebrity's that remain in the competition and/or who have performed a dance against each other. The celebrities falling in between highest and lowest get the appropriate number in between the highest and lowest.

17. Each viewer 190 vote or SMS vote registers ONE vote for your nominated Celebrity to stay in the show. The Celebrity with the lowest viewer vote gets 1 point and the Celebrity with the highest number of votes gets the number of points equal to the number of Celebrity's that remain in the competition, e.g. 10 points if there are 10 celebrities left, 6 points if there are six celebrity's left etc. The celebrities falling in between highest and lowest get the appropriate number in between the highest and lowest.

18. After all the dance challenges have been performed in each episode, the judges' rankings are then added to the viewers' rankings to produce a result for that episode. In the event of a tie, the Celebrity that scored a higher rank with the viewers will rank above the other celebrity who was on the same ranking.

19. There will be eliminations throughout the series until there is one Celebrity remaining which will then be determined as The 'Dancing With The Stars' winning 'Celebrity'.

20. Under no circumstances (including but not limited to any act or omission on the part of The Seven Network, Freehand Productions Pty Ltd and the Service Provider) will The Seven Network or Freehand Productions Pty Ltd or Service Provider be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use or access of, or any inability to use or access the SMS or 1902 voting services.

21. Except where not able to be excluded by law: a) all content for voting Services are provided "as is" and without warranties of any kind, either express or implied, b) Your mobile telephone carrier and its suppliers expressly disclaim all warranties of any kind including but not limited to implied warranties of merchantability and fitness for a particular purpose, c) Neither your mobile telephone carrier nor The Seven Network, Freehand Productions Pty Ltd or the voting Service Provider warrants that access to both the SMS and 190 voting Services will be available, uninterrupted, free from delay or error-free or that any defects will be corrected.

22. The charges for all SMS and 1902 voting Services will appear on your next mobile / telephone bill. All queries relating to mobile / telephone bills should be directed to your mobile or telephone carrier.

23. All information, text, audio, material, graphics, software and advertisements contained in or forming the Voting Services ("Content") are the property of The Seven Network and Freehand Productions Pty Ltd, its suppliers and/or licensors (including your telephone carrier) unless expressly indicated otherwise. The Content is protected by Australian and international copyright and trademark laws. You must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute this Content in any way unless expressly authorised in writing by The Seven Network and Freehand Productions Pty Ltd.

24. SMS is not a guaranteed delivery communication tool. The Seven Network, Freehand Productions Pty Ltd and the Service Provider cannot accept responsibility for any SMS messages not received, any SMS reply message or for any delay in the delivery of the SMS message due to technical disruptions, network congestion, network failures or for any other reason. A vote is validated and included in the tally following receipt into the m.Net Corporation database from the carriers.

25. If for any reason this voting service is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this voting service, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the voting process, take any action that may be available, and to cancel, terminate, modify or suspend the voting service.
